Terms of Service for pethsapp

1. Agreement to Terms

By using the pethsapp mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms affect your legal rights and obligations. This document should be read in conjunction with our Privacy Policy.

2. The App and Its Purpose

The App is provided by the Pierre Elliott Trudeau High School Student Activity Council ("TSAC") to students of Pierre Elliott Trudeau High School ("PETHS"). The App provides features such as a points system for school event participation, event tracking, and school-related announcements (the "Services"). The purpose of the App is to enhance student engagement and participation in school life.

3. Eligibility

The App is intended solely for use by current students of Pierre Elliott Trudeau High School. Your account may be deactivated if you are no longer an enrolled student at PETHS.

4. User Accounts

To use certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account and are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to reclaim usernames that are inactive, violate trademark, or are otherwise deemed inappropriate in our sole discretion.

5. User Conduct and Responsibilities

As a user of the App, you agree that your conduct is subject to all applicable school policies and regulations. By using the App, you explicitly agree to abide by the YRDSB Code of Conduct, as well as all rules and policies of Pierre Elliott Trudeau High School. Failure to adhere to these codes of conduct may result in disciplinary action, including but not limited to the suspension or termination of your App account and other school-based consequences.

You further agree not to use the App to:

• Engage in any form of bullying, harassment, intimidation, or any behavior that creates a negative or unsafe environment for other users.
• Create a username or post any content that is offensive, obscene, or otherwise objectionable.
• Violate any law or regulation.
• Infringe the rights of any third party, including intellectual property, privacy, or publicity rights.
• Interfere with or disrupt the App or servers or networks connected to the App.
• Use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the App in a manner that sends more request messages to the App servers than a human can reasonably produce in the same period by using a conventional on-line web browser.
• Attempt to gain unauthorized access to the App, user accounts, or computer systems or networks connected to the App.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

6. Points and Rewards System

The App includes a points-based rewards system to encourage school participation. Points are awarded based on criteria determined by TSAC and school administration, such as attending events or participating in activities.

• Points have no monetary value and cannot be redeemed for cash or transferred between users.
• TSAC reserves the right to modify, suspend, or terminate the points system at any time, with or without notice.
• Any attempt to fraudulently acquire points, manipulate the system, or otherwise engage in dishonest behavior will result in the forfeiture of all points and may lead to account suspension or termination and further disciplinary action.

6.1. Account Termination for Abuse

Given that each account is uniquely tied to a student, maintaining the integrity of the system is paramount. We reserve the right, at our sole discretion, to immediately and permanently terminate any account found to be abusing the points system or violating these Terms.

This includes, but is not limited to, exploiting software bugs, using automated scripts to accumulate points, or any other activity deemed as manipulation. Upon termination, all accumulated points and rewards will be forfeited. As accounts are linked to your official student email, you will not be permitted to create a new account. Decisions regarding account termination are final and are not subject to appeal.

7. Intellectual Property and Third-Party Content

The App and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of TSAC and its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the App for your personal, non-commercial use.

The App may also contain links to third-party web sites or services that are not owned or controlled by TSAC. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services.

8. Device Permissions

The App may request certain permissions on your device, such as camera access for scanning QR codes and notification permissions. You can control these permissions through your device settings. Disabling certain permissions may impact the functionality of the App.

9. Third-Party Links & Content

The App may contain links to third-party websites or resources. You acknowledge and agree that TSAC is not responsible or liable for the availability or accuracy of such websites or resources, or the content, products, or services on or available from them. Links to such websites or resources do not imply any endorsement by TSAC. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may do so by contacting us. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. App Availability and Performance

The App is provided "as is" without any guarantees of continuous availability or error-free operation. TSAC does not warrant that the App will function without interruption or be free from technical issues. You acknowledge that temporary outages, maintenance periods, or technical difficulties may occur and agree that TSAC is not responsible for any inconvenience caused by such events.

12. Limitation of Responsibility

TSAC's responsibility is limited to providing the App as a school engagement tool. We are not liable for any indirect consequences arising from your use of the App, including loss of points, missed opportunities, or technical issues that may affect your experience. Our maximum liability for any issues related to the App shall not exceed the value of any physical rewards you may have earned through the points system.

13. User Responsibility

You are fully responsible for your conduct while using the App and for any consequences that may arise from violations of these Terms or school policies. You agree to take responsibility for any actions taken under your account and understand that misconduct may result in disciplinary measures both within the App and at school.

14. Changes to These Terms

TSAC reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a new effective date. Your continued use of the App following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically to stay informed of any updates.

15. Enforcement and Consequences

These Terms are actively enforced. Violations will be taken seriously and may result in immediate account termination, loss of all accumulated points and rewards, and potential referral to school administration for further disciplinary action. TSAC reserves the right to investigate any suspected violations and to take appropriate action as deemed necessary.
